Collin County District Attorney Greg Willis has publicly addressed allegations made by Mike Howard, the lead defense attorney during Karmelo Anthony's trial for the murder of Austin Metcalf. Anthony was sentenced to 35 years in prison following his conviction.
Howard's affidavit, submitted as part of Anthony's appeal, claims that prosecutors breached a "gentlemen's agreement" that aimed to restrict character evidence about Anthony and the Metcalfs. He also contends that a critical closed-door hearing was rushed, hindering the defense's preparation.
Willis, however, asserts that court transcripts obtained by CBS News Texas contradict many of Howard's claims. He stated, "It's clear that many of these claims don't match what actually happened in court." During a private meeting regarding Anthony's potential testimony, Howard acknowledged that the agreement was upheld, and Judge John Roach Jr. emphasized he would not enforce informal agreements in a criminal case.
Howard's affidavit suggests he was confident Anthony would testify but claims the judge limited their preparation time. In contrast, the transcript indicates that the judge provided Anthony with a detailed explanation of his rights and allowed over 30 minutes for the defense to deliberate, during which Anthony consulted his parents before deciding not to testify.
Willis expressed surprise and disappointment at Howard's assertions, stating, "I was surprised, disappointed, and frankly a little confused." He defended the prosecution's conduct, asserting that the case was handled fairly and professionally.
